Relationship breakdown
Family and relationship breakdowns are often incredibly stressful and emotionally challenging. Our dedicated Family team is here to provide robust and expert guidance on issues involving relationship breakdown whether marriage, civil partnership or cohabitation. We are committed to supporting you every step of the way.
Whether through Court proceedings or using non-Court dispute resolution, for example, mediation (facilitated discussions with a neutral third party); Collaborative process (where both parties and their collaborative practitioners work together to reach an agreement); negotiation or arbitration (a private process where a chosen arbitrator makes a binding decision) we will use our years of experience and expertise to secure the best possible outcome for you.
Divorce and Separation
If your marriage or civil partnership has come to an end, we will guide and support you through the entire divorce process. The new ‘no-fault divorce system,’ introduced by the Divorce, Dissolution and Separation Act 2020, aims to reduce conflict by removing the need to place blame on either party. Instead, the focus is on a smoother, less contentious separation, which can also help reduce legal costs.
The process starts with an application, which can be submitted by one person or jointly. It proceeds with the Conditional Order (previously known as the Decree Nisi), a statement that the Court sees no reason why the divorce cannot go ahead, followed by the Final Order (formerly the Decree Absolute) that legally ends the marriage.
We are here to ensure the process is as straightforward and stress-free as possible.
Cohabitation and Separation
Relationship disputes don’t only happen between married couples or civil partners.
Cohabiting couples (those who live together without being married) can also face significant challenges. While cohabiting partners do not currently have the same automatic legal rights as married couples, we can provide expert advice on resolving property and financial issues, particularly under the Trust of Land and Appointment of Trustees Act 1996 (TOLATA), which governs how property is owned or divided when disputes arise.
Financial Remedies
We have extensive experience in resolving financial disputes that come with relationship breakdowns. We can advise on a wide range of issues, including maintenance obligations (payments to support a former spouse or partner), child support, lump sum payments, property adjustments, and pension sharing.
Our goal is to ensure that your financial future is secure.
